Medical malpractice in the United States is not uncommon. What may be even more common, however, is the same doctor committing an act of medical malpractice more than once. In fact, a recent study published in The New England Journal of Medicine suggests that out of all the medical malpractice claims filed in the United States every year, one percent of doctors may be responsible for up to a third of those claims. The researchers also found that the strongest indicator of whether or not a doctor would be sued for medical malpractice was whether or not the doctor was sued in the past.
 

The Data

In order to reach their conclusions, researchers looked at 66,426 medical malpractice claims filed between 2004 and 2014. Then, the researchers considered how often a doctor paid out for a malpractice claim, and also considered things such as the doctor’s age, type of doctor, and other factors.
 
They found that one percent of doctors accounted for 32 percent of all paid claims. They also found that a doctor who had paid out three times in the past was three times more likely to be sued again (the chance that a doctor would be sued again went up with each time the doctor paid out a medical malpractice claim). The median payment made was $205,000.
 
Perhaps most shocking thing in the study was the fact that at least 126 doctors involved in the study had paid medical malpractice settlements more than five times. These doctors were 12 times more likely to be sued again than were other doctors with fewer payouts.
